RENTAL POLICIES: (BE SURE TO READ ALL POLICIES BEFORE PROCEEDING WITH RESERVATION)
Rentals are to be reserved by current Apple Valley Property Members (Definition under Artice 3.3 of the Bylaws), who are in good standing ONLY.
All other reservations will be cancelled less a $25 cancellation fee.
Boats that are going in the Dock Rentals MUST already have Apple Valley Decals.
Ohio Registrations MUST be brought with the Apple Valley Property Member when checking the boat in.
CANCELATION POLICY: One person's perfect day on the water may be too hot for somebody else and too cold for another. Last minute cancellations are costly. At the same time, we understand that things come up.
Full refunds will only be issued with a 7 days notice.
Any cancellations less than 7 days yet more than 48 hours may be refunded less a 25% fee. The other option is to reschedule to another available time, within the current season. If a future cancellation results, there will be a 25% fee regardless of notice.
No shows and cancellations within 48 hours will not be refunded.
RAIN POLICY: We do not allow for cancellations for less than ideal weather.
If the weather is bad due to high winds, lightening, storms in the area, or any unsafe conditions:
Rental may be rescheduled to another available time, within the current season.
Rental may be refunded less 25%
If you are on the rental and sever weather brings a surprise to your fun, you may reschedule to another available time for the unused time remaining, within the season.
No refunds for early returns.
Rules:
Rentals are to members in good standing only. (Family Pass Holders may NOT rent)
Must be 21 or over to rent.
Damage to rental docks and any equipment is the customer’s responsibility as agreed upon in rental agreement.
RENTAL AGREEMENT
IN CONSIDERATION of the RENTAL AGREEMENT, LESSOR does lease to the undersigned (hereafter referred to as the LESSEE) the RENTAL DOCK described herein. LESSEE agrees that said RENTAL DOCK will not be occupied by any other person than shown in the RENTAL AGREEMENT .
INCIDENCE REPORTING: I, the LESSEE agree to report any accident, malfunction, breakdown or damage to the RENTAL DOCK to the LESSOR immediately.
SECURITY/DAMAGE: I, the LESSEE,understandFINANCIAL RESPONSIBILITY is required to rent the RENTAL DOCK and will be charged to the credit card on file and/or other means; and I agree the FINACIAL RESPONSIBILITY will be released after the completion of the rental period, provided no damage to the equipment is found, and no additional charges have accrued as outlined in this AGREEMENT. I understand as the LESSEE, I am responsible for all damages.
DAMAGE TO EQUIPMENT: I, the LESSEE, agree to return RENTAL DOCK in the same condition as originally rented, and understand that I am fully and solely responsible for any damages sustained to the RENTAL DOCK while it is in my possession. If the RENTAL DOCK is not left in suitable condition, I acknowledge, understand, and agree that by signing this RENTAL AGREEMENT, I am authorizing charges to credit card on file, or financial responsibility by other means, for any damages sustained to RENTAL DOCK.
RETURN OF EQUIPMENT: I, the LESSEE, understand that I will be charged for the FULL RENTAL RESERVATION TIME as listed above. No refunds are given for late arrivals or early returns. I agree to vacate the RENTAL DOCK by the promised time as stated above and that failure to do so will result in a minimum $25 LATE FEE PER 30 MINUTES and may result in the loss of future rental privileges.
LIABILITY AGREEMENT: I, the LESSEE, hereby release and hold harmless from any legal liability, the LESSOR from any and all liability for damage and injury or death to myself, or any person or property resulting from the selection, maintenance or use of this RENTAL DOCK; and for any claims based upon negligence, breach of warranty, contract, claim or other legal theory, accepting myself, LESSEE, and I hereby accept full responsibility for any and all such damages or injury which may result. It is understood and agreed that RENTAL FEE is a presently earned fee for the use of the equipment and that the FINANCIAL RESPONSIBILITY against costs of repairs or cleaning that my be required because of physical damage to the RENTAL DOCK during the RENTAL PERIOD or against liability that LESSEE may incur to LESSOR pursuant to this AGREEMENT. Further, I, the LESSEE, am responsible for all damages and/or losses to the RENTAL DOCK or any of its contents during the period. I, the LESSEE, indemnify and hold LESSOR harmless from any loss, damages, expense or claim, including attorney’s fees, and costs arising out of my acts or omission to act, or those with me during the use of the RENTAL DOCK during the RENTAL PERIOD.
I, the LESSEE, have read all parts of the RENTAL AGREEMENT and fully understand the terms and conditions as set forth.
